The photograph of a battered Rihanna posted on TMZ following Chris Brown’s domestic abuse arrest on February 8 may actually be the worst thing to happen to the prosecutor’s case against the singer. Brown’s lawyer Mark Geragos yesterday said he’s trying to find the person who leaked the evidence to the press because the photographs were never meant to be revealed outside of court, and thus the case should be dismissed.
“The leaks can form the basis for a motion to dismiss the case in regards to outrageous governmental misconduct,” Geragos told E! Online after the hearing.
TMZ is not releasing a comment at this time.
Neither Rihanna nor Brown, who faces two felony charges for assault and making criminal threats, were present at yesterday’s hearing. Meanwhile, Rhianna’s attorney Donald Etra said it’s yet to be determined whether the “Umbrella” singer will testify in court against her ex-boyfriend.
“The D.A. has not informed us whether or not Rihanna will be called to testify,” Etra told E!
A preliminary hearing was scheduled for May 28.
